As an employee in West Virginia, you have certain rights such as:

  • The right to work in an environment free of sexual harassment, unwelcome touchings, looks, and comments; and the right to report it without being retaliated against

  • The right to work in a safe environment, and the right to report to OSHA, AFLAC, or MSHA, etc. if the work environment is not safe, without fear of being fired or retaliated against

  • The right to be accommodated if you are suffering from a disability and can still do your job, but need some reasonable adjustment by your employer

  • The right to file a workers' compensation claim, if you are injured on the job, without having to worry about being fired or retaliated against

  • The right not to be discriminated against because of your race, sex, disability, age, ethnic background, religion, etc.

  • The right to be paid your wages when they are due

  • The right to be paid overtime, if you feel your employer just gave you the title of manager, but you don't have managerial duties and frequently work overtime
